Namitra Bwala, a student at Lead British International School in Gwarimpa, Abuja, has taken legal action against the institution following a highly publicized incident of bullying that she endured. Ms. Bwala has filed a civil lawsuit at the High Court of the Federal Capital Territory, seeking damages totaling N500 million for what she alleges to be the school’s negligence in providing a safe and conducive learning environment.
In the lawsuit, Ms. Bwala contends that Lead British International School failed in its duty to protect her from physical and emotional harm inflicted by fellow students. Moreover, the school allegedly neglected to inform her parents about the incident until it gained traction on social media.
Marvin Omorogbe, Esq., Founding Partner of Deji Adeyanju and Partners, representing Ms. Bwala, emphasized that the lawsuit aims to instigate significant changes and implement adequate measures to prevent similar incidents from occurring in the future.
The legal action, with case number FCT/HC/CV/2341/24, seeks various forms of relief, including a declaration that the school owes a duty of care to its students and that its failure to prevent the bullying and notify Ms. Bwala’s parents constitutes negligent conduct.
Furthermore, the lawsuit demands an order directing the Defendant to pay N500 million in general damages to Ms. Bwala for the breach of duty of care and negligent conduct resulting in assault, emotional distress, pain, trauma, and breach of privacy.
The plaintiff seeks several declarations from the court, asserting Lead British International School’s obligation to protect students from harm and its failure to do so. The lawsuit also highlights the school’s alleged failure to promptly inform parents of the incident and initiate an immediate investigation into the assault and emotional trauma endured by Ms. Bwala.
Ms. Bwala’s legal action underscores the importance of holding educational institutions accountable for safeguarding students’ well-being and ensuring a supportive learning environment.
